Class Action Claims

Representing Investors Nationwide

When a group of shareholders have suffered similar losses due to security fraud, a class action may be filed on their behalf. With this type of court action, one lawsuit is filed for a group of shareholders as opposed to each one filing on his or her own. This can help ensure all victims are compensated fairly while also reducing the length and number of court proceedings regarding a single case.

The securities fraud class actions attorneys at Colling Gilbert Wright & Carter have over eight decades of combined experience helping shareholders get justice. No matter if you are joining a class action or interested in starting one, we can take your case and help ensure justice is served.

If you are a part of a group of shareholders who have suffered damages following securities fraud, please contact Colling Gilbert Wright & Carter online or call 866-352-3476 today to schedule a free consultation with one of our class action attorneys.

Federal Rules of Civil Procedure

Class action lawsuits are permissible under Rule 23 of the Federal Rules of Civil Procedure. Rule 23 holds that a class action lawsuit may be filed by one or more members of a class when:

  • The class is so numerous that joinder of all members is impracticable
  • There are questions of law or fact common to the class
  • The claims or defenses of the representative parties are typical of the claims or defenses of the class
  • The representative parties will fairly and adequately protect the interests of the class

The securities fraud attorneys at our firm will assess your claim free of charge to help you determine if all prerequisites for class action are met.

It is possible to be a member of a class and still opt out of class action. If you do this but still want to pursue action, you will need to hire your own attorney. During your free case evaluation we will discuss all of your options to help you choose which is best suited to meet your specific needs.
